By listing artwork on the platform, artists grant Auria Art House a limited, non-exclusive, royalty-free licence to display and promote artwork images solely for platform operation and marketing. This licence ends when the listing is removed, except to fulfil in-progress orders.
Artist rights include reproduction rights, distribution rights, derivative work rights, public display rights, and attribution (moral) rights under the Copyright Act, 1957.
Buyer Rights
You Receive
- Personal, non-commercial display rights
- Right to resell the physical artwork

You Do NOT Receive
- Copyright ownership (unless explicitly sold)
- Right to reproduce or make copies
- Right to create derivative works
- Right to commercially exploit the image
- Right to use in advertising or promotion
Important for Buyers
Purchasing physical artwork does not transfer copyright. For any commercial use of artwork images, you must obtain explicit written permission from the original artist.

Trademark Policy
Our Protected Marks
The following are protected trademarks of Link2Trade Ventures LLP: "Auria Art House" name, the Auria Art House logo, all taglines, slogans, and distinctive design elements. You may not use these marks in business names, domain names, advertising, or in any way that implies endorsement or affiliation without our prior written consent.
Third-Party Trademarks
Artists and users must not use others' trademarks without permission, create confusion with well-known marks, imply false affiliation, or misattribute trademark ownership. Report trademark infringement to legal@auriaarthouse.com with the trademark registration details, description of unauthorised use, and evidence of confusion or dilution.
Section 08
Authenticity & Verification
Artist Identity Verification
We verify artist identity, ownership claims, and original creator status through government-issued ID, portfolio review, and social media or website links. Proof of creation may be requested if an artwork is disputed.
Authenticity Standards
- Original artworks must include a Certificate of Authenticity with the artist's signature
- Prints and reproductions must be clearly labelled with edition numbers and artist approval
- Provenance documentation required for high-value works
- No misrepresentation of medium, edition, or origin is permitted
Reporting Fake or Unauthorised Listings
If you suspect a listing is fake, plagiarised, or an unauthorised reproduction, report it to authenticity@auriaarthouse.com with a link to the listing, evidence of the original work, and your relationship to the original artwork.
Section 09
Fair Use & Permitted Uses
Indian copyright law recognises certain fair dealing exceptions under Section 52 of the Copyright Act, 1957, including private study, research, criticism, review, and news reporting — provided proper attribution is given and the use does not harm the commercial value of the work.
Permitted
- Viewing artworks on the platform
- Sharing platform links to listings
- Writing reviews with small image previews
- Personal study and inspiration
Not Permitted
- Downloading and redistributing images
- Using artwork images for commercial purposes
- Creating merchandise using artwork
- Claiming another's work as your own
Section 10
AI & Derivative Works
AI-Generated Art
Artists who use AI tools in the creation of artworks must clearly disclose this in their listing description, specifying the AI tools or platforms used. AI-generated works may have limited copyright protection under Indian law, which is subject to ongoing legislative development. Buyers will be informed of AI involvement in any such listing.
Evolving Legal Framework
The legal status of AI-generated content under Indian copyright law is still evolving. Auria Art House will update this policy as the legal landscape develops.
Derivative Works
Works based on another artist's existing work require explicit written permission from the original creator. The derivative work must significantly transform the original — minor modifications do not constitute transformation. Inspiration is permitted; direct copying is infringement. The test applied is whether an ordinary observer would recognise substantial similarity to the original.
Section 11
Privacy & Publicity Rights
Right of Publicity
Artworks depicting identifiable individuals for commercial purposes require a valid model release. Artworks depicting children require parental or guardian consent. Public figures may have limited protection for matters of public interest, but this does not extend to commercial exploitation.
Property & Architectural Rights
Photographing or depicting private property requires the owner's permission. Trademark-protected buildings, distinctive architectural works, and certain landmark locations may carry additional restrictions on commercial use.
Section 12
Enforcement & Remedies
Actions We May Take
- Remove or disable access to infringing content immediately
- Suspend or permanently terminate accounts
- Withhold pending payments pending investigation
- Report serious violations to law enforcement authorities
- Cooperate fully with court orders and legal proceedings
- Permanently ban repeat infringers from the platform
Legal Remedies for Rights Holders
Rights holders whose intellectual property is infringed may pursue injunctions, monetary damages, account of profits, criminal prosecution in serious cases, and recovery of legal costs — all available under the Copyright Act, 1957 and the Trade Marks Act, 1999.
Section 13
International Considerations
Intellectual property laws vary by jurisdiction. Auria Art House primarily complies with Indian law. International treaties including the Berne Convention and TRIPS Agreement may apply. Users are responsible for compliance with IP laws in their own jurisdiction. For international sales, buyers must verify import/export regulations, ensure compliance with local IP laws, and be responsible for all applicable customs duties and taxes.
Section 14
Education & Resources
We provide copyright education and best practice guides for artists, including IP protection tips, fair dealing guidelines, and links to relevant legal resources. We help artists understand their rights, register copyrights, protect their work, license appropriately, and respond to infringement.
For questions about IP rights and how they apply to your use of the Auria Art House platform, contact our legal team at legal@auriaarthouse.com.
Section 15
Policy Updates
This policy may be updated to reflect legal changes, platform evolution, best practice developments, and user feedback. Changes are effective upon posting with an updated "Last Updated" date. Significant changes will be communicated to registered users by email or platform notification.
By continuing to use Auria Art House after changes take effect, you accept the revised policy.
